Court confirms Chechen resident’s right to compensation for injury

The Supreme Court of Chechnya cancelled a court’s decision on a claim filed by the Russian Ministry of Finance, which challenged the award of compensation amounting to 400,000 roubles to Shamsold Akhyadov, a resident of Chechnya, for being wounded during the second Chechen military campaign.

On September 30, 1999, the hostilities in Chechnya and the regions of Northern Caucasus bordering on it began and lasted until August 2009.

According to the website of the Supreme Court (SC) of Chechnya, on September 6, 2019, in Grozny, a court awarded compensation to Shamsold Akhyadov. However, on April 11, 2022, the Russian Ministry of Finance demanded a review of the court’s decision, claiming that the court incorrectly identified the defendant who should pay the money. As a result, the court cancelled the decision on compensation for non-pecuniary damage. Shamsold Akhyadov filed a complaint to the Supreme Court of the republic.

The “Caucasian Knot” has also reported that the Grozny court refused to grant the claims filed by Khozha Taramov, Zalpa Dataev, Abaz Taramov, Zainap Paizueva, and Abdula Taramov and Mata Taramova, who sought compensation for the deaths and injuries of their relatives in Argun in September 2000.

On October 23, 2018, the European Court of Human Rights (ECtHR) ordered Russia to pay compensation of 1.5 million euros to relatives of 21 residents of Chechnya who disappeared during the special operations conducted by the Russian troops. In October 2015, the ECtHR awarded the compensation amounting to 300,000 euros to Taisa Abakarova, a native of Chechnya, whose entire family perished in the bombing of Katyr-Yurt in February 2000. In 2005, the ECtHR granted a similar claim filed by Zara Isaeva, a resident of Chechnya, whose son and three nieces perished during a shelling attack on Katyr-Yurt.
