Presidium of Krasnodar Territorial Court cancels decision to return land plot in Sochi to pensioner Nina Dubovaya

The Presidium of the Krasnodar Territorial Court has cancelled the decision of the first instance court concerning the claim of pensioner Nina Dubovaya. Earlier, the District Court has returned to the woman her land plot.

The "Caucasian Knot" has reported that Nina Dubovaya, an owner of a land plot in Poltavskaya Street, was deprived of her land plot after several cadastral numbers were assigned to it. The construction of a high-rise building was started on the land plot. The Mayoralty has filed a claim to recognize the building as illegal. On March 18, 2015, the Central District Court of Sochi granted the motion filed by Nina Dubovaya.

The Court's decision on the return of the land plot to Nina Dubovaya came into force on July 2, 2015. However, the case was reclaimed at the complaint of a person who was not a party to the trial. The complaint states that the rights of that third person were affected by the decision of the District Court, reports the press service of the Krasnodar Territorial Court.

According to Nina Dubovaya, the case is being considered for five years already, and during that period of time, "a high-rise building has been built and sold" on her land plot. Nina Dubovaya has explained that on April 20, the Krasnodar Territorial Court cancelled the decision and sent the case to the first instance court for reconsideration. Meanwhile, according to the pensioner, the court has not listened to her arguments. Nina Dubovaya has added that she intends to apply to the Investigating Committee of the Russian Federation (ICRF).
