The Supreme Court of Dagestan brought a standing judgment on the verdict of compensation to Abdulkarimov exculpated from a charge of committing an act of terror

A Board of three judges of the Supreme Court of Dagestan brought a standing judgment on the verdict of Sovietsky district court of Makhachkala of paying a compensation of 100 thousand rubles upon Abdulkhalim Abdulkarimov's lawsuit with a demand to exact 15 million rubles compensation damage from the Ministry of Finance for unlawful making him criminally liable for the act of terror in Kaspiysk in May of 2002.

Lawyer Sapiyat Magomedova represented Abdulkarimov's interests at the trial.

On May, 11, judge of Sovietsky federal court of Makhachkala Gasankadi Djumaidiev brought a verdict to grant the claim in part, i.e. exact 100 thousand rubles moral and material damage from the Ministry of Finance.

Sapiyat Magomedova told the "Caucasian Knot" correspondent that immediately after the judgment was passed she appealed against it considering the sum imposed by the judge as compensation for her client's moral suffering insufficient.

"I entered a motion of transporting plaintiff Abdulkhalim Abdulkarimov who is serving penalty for other charges to Dagestan for direct participation in the trial. I consider that nobody will describe better than the sufferer himself how it all happened, show the wounds he got at the moment of detention, tell about the suffering he experienced when accused of such a high-profile and cruel crime, how the investigation was conducted and many other things. But my motion was dismissed. The case was considered without participation of the sufferer himself both for the first time and in the appellate litigation, i.e. the Supreme Court", Magomedova said.

In the registry of the Supreme Court of Dagestan the "Caucasian Knot" correspondent was told that the case was considered by a board of three judges under the chairmanship of judge Irina Avgustina.

"Two claims were considered concurrently. The first was that of plaintiff Abdulkhalim Abdulkarimov who appealed against the verdict of the first instance court demanding compensation of moral and material damage for unlawful making him criminally liable. The second one was from Department of Federal Treasury whose representative demanded abrogation of the same judgment denying Abdulkarimov's right of rehabilitation", a source in the Supreme Court of Dagestan reported.

As a result, the court dismissed both appeals bringing a standing judgment on the verdict of Sovietsky court of Makhachkala.

Sapiyat Magomedova said that she would appeal against the verdict in a higher cassational court. "If the Russian courts do not acknowledge Abdulkarimov's right of compensation for material and moral damage in corpore we will have to appeal to the European Court of Human Rights", she declared.
