Court in Rostov-on-Don rejects complaint of the activist of "The Other Russia" on his custody conditions in the pre-trial facility

In Rostov-on-Don, the Pervomaiskiy District Court has rejected the complaint of the activist of "The Other Russia" Pavel Nagibin on his custody conditions at the KPZ (pre-trial detention facility) of the Kirovskiy District Interior Department (OVD) of Rostov-on-Don after his detention at the picket with a demand to register the federal list of candidates for deputies from "The Other Russia" coalition on November, 24, 2007.

Mr Nagibin had stated that when he was at the KPZ, he was given no food and bed accessories, although he had been kept there for 2 days. Besides, he says that his relatives were not informed about his detention.

The "Caucasian Knot" correspondent informs that during the court hearing a representative of the Kirovskiy OVD has stated that Nagibin would not want his relatives to know about his detention.

Besides, according to the governmental order, the norm of daily subsistence (nutrition) is prescribed to temporary isolation and accommodation-distribution facilities of the Ministry of Internal Affairs of the Russian Federation, while "the order of providing meals to the persons contained in the Room for Detainees has not been set up so far, and these persons shall get the food brought by their relatives."

Consequently, the court has concluded that the actions of the employees of the Kirovskiy OVD while Pavel Nagibin was kept during his administrative detention were not contradictory to the requirements of the legislation, "did not breach the rights and freedoms of the applicant, therefore, the application lodged by Nagibin, P. N., shall be rejected."
