Mobilized soldier convicted in Novocherkassk for refusing to take part in combat missions

The Novocherkassk Garrison Military Court has sentenced Evgeny Borodin, a mobilized soldier, to a term in a penal colony, finding him guilty of refusing to be sent to the special military operation (SMO) zone.

The "Caucasian Knot" has reported that the sanction for a failure to comply with an order given "during the martial law, in wartime, or in conditions of an armed conflict or military operations" is from two to 10 years of freedom deprivation. Under this article, a court in Volgograd has sentenced Vyacheslav Pikalov, a contract soldier, to two years in a penal colony.

According to the verdict, Borodin was mobilized in September 2022, and in April 2024, "wishing to evade military service", after the order of the military unit commander to send him to the SMO, "refused to take part in hostilities" because he was "worried about his life and health."

The above Military Court has treated "the defendant's full admission of his guilt, remorse for his actions, and the fact that he had taken part in a military operation during which he was wounded" as mitigating circumstances: Borodin was sentenced to two years and three months in a penal colony.
