In Nalchik, court recognizes participation in battles in Ukraine as a mitigating circumstance in drug cases

In cases on drug trafficking, military Ibragim Polonkoev was sentenced to a fine of 15,000 roubles, and contract soldier Elbek Makaev – to a suspended sentence. Among the extenuating circumstances, the court mentioned the participation in the special military operation in Ukraine and departmental awards.

In Kabardino-Balkaria, two military men were given the minimum sentence for possession of drugs, as the court considered their participation in the special military operation (SMO) in Ukraine and departmental awards as a mitigating circumstance. The military men faced up to three years of imprisonment in a penal colony, but they received a fine and a suspended sentence, the “Kavkaz.Realii”* reported.

According to a report released on the website of the Nalchik Garrison Military Court, Ibragim Polonkoev took two grams of the drug from a hiding, with which he was detained by the police. The man pleaded guilty and repented of his deed. The court took into account his origin from a large family, positive characteristics from home and military service, and his participation in the special military operation and awards for it.

During an inspection at a checkpoint, the drug was confiscated from military Elbek Makaev, who had earlier criminal record for theft and robbery. The man said that he had found the drug and decided to use it.

The “Caucasian Knot” has also reported that in cases of evasion from military service, the military court in Nalchik sentenced military men to real terms of imprisonment. So, mobilized Takhir Zhilov was sentenced to imprisonment in a penal colony in a case on unauthorized abandonment of a military unit.
