CD with data on teenager's murder destroyed in court of Kabardino-Balkaria

At the Urvan District Court (Kabardino-Balkaria), the CD with the materials of the investigatory experiment on the criminal case initiated on the fact of murder of Islam Kumyshev, 14, was found drilled through with a bore. The "Caucasian Knot" correspondent learnt about it from well-informed sources.

Islam Kumyshev, 14, was killed on July 14, 2006, when he was fishing in the lake in the vicinity of Chernaya Rechka village in Kabardino-Balkaria.

The murder has caused a broad public resonance. The letter addressed to the President of the Kabardino-Balkarian Republic (KBR) with s demand to give attention to this case was signed by more than 300 residents of the village.

In spring of 2007, the Urvan District Court sentenced Jabrail Sibekov who had shot the teenager dead to three years of freedom restriction in a colony-settlement. This decision was appealed against by the injured party in the appellate order in connection with the verdict leniency; however, the District Court upheld its previous verdict.

Meanwhile, the residents of the village believe that the reason of this lenient verdict lies in the fact that as of the moment of the murder Safrail Sibekov, Jabrail's brother was the head of the village administration.

The villagers report that they experience numerous threats and pressure from the Sibekovs.

The Urvan Prosecutor's Office had presented charges under Part 1, Article 105 of the RF Criminal Code (premeditated murder), however, the court re-qualified the crime into Article 109 of the RF CC (involuntary manslaughter). The relatives of the victim categorically disagree with the incriminated qualification and are going to seek for reconsideration of the case.
