SC sides with authorities in Dagestani's dispute about compensations

The Supreme Court (SC) of Dagestan has upheld the denial of compensation to Surupasha Khakiev, a resident of the Novolaksky District, for his house confiscated during the Stalinist deportation of the Akkin Chechens.

The "Caucasian Knot" has reported that the Aukh District, where Akkin Chechens had lived, was liquidated in 1944 after the Stalin's deportation of Chechens and Ingushes. Thirteen years later, the Akkin Chechens, like the rest of the deported Vainakh nationals, were allowed to return to their historical homeland.

For about 30 years, the Chechens of Dagestan have been waiting for the restoration of the Aukh District, in the territory of which their ancestors had lived before the Stalinist deportation. Authorities have promised to fulfil their demand, but the stumbling block was the need to resettle the Laks living now in the territory of the present Novolaksky District.

The Dagestani SC has denied Surupasha Khakiev's lawsuit against the republic's authorities on the resettlement of the Lak population. Khakiev sought compensation for the house confiscated in 1944 during deportation, the "Kavkaz.Realii"* project reports.

Mr Khakiev has pointed out that his family lost their house during the repressions against Akkin Chechens. His parents were evicted to Kyrgyzstan; and he was born there in 1953. In 2009, the new owners of the house of the Khakiev family received compensation for it, but did not return the house to its former owners.

The SC has refused to satisfy the lawsuit, since Khakiev failed to prove that the house was built before 1944 and is subject to gratuitous transfer to him under the rehabilitation, the project has explained.
