Rights defenders explain motives for complaint to the ECtHR on Musaeva's case

A complaint has been filed with the European Court of Human Rights (ECtHR) concerning the case of Zarema Musaeva, indicating violations of at least six articles of the European Convention for the Protection of Rights and Fundamental Freedoms (ECHR), including the threat to life and the prohibition of torture.

The "Caucasian Knot" has reported that Zarema Musaeva, who suffers from diabetes, was placed under administrative arrest under the case of petty hooliganism; and from February 1 until April 1 she is under arrest on charges of assaulting a law enforcer.

In Musaeva's case, a complaint was filed with the ECtHR, the "Caucasian Knot" correspondent was told in the "Committee against Torture" (CaT)*, which protects Musaeva's rights.

According to Natalia Kurekina, the head of the CaT*'s press service, in the complaint, the lawyers pointed to the violation of at least six articles of the ECHR.

"First of all, this is Article 2 – 'Threat to life', as there was a direct threat to life in the way she [Musaeva] was abducted. Then, Article 3 – 'Prohibition of Torture', since the way she was carried out after being detained in Nizhny Novgorod barefoot in the snow, was practically torture; Article 5 – 'Right to Freedom and Personal Inviolability', as she was detained for forced bringing four days before the formal interrogation and is now forcibly kept in Chechnya on fabricated grounds; Article 6 – 'Right to a fair trial'; Article 8 – 'Unlawful interference with privacy', because law enforcers illegally broke into her apartment; and Article 13 – 'Right to an efficient remedy'," Ms Kurekina has explained.

*Currently, the "Committee against Torture" (CaT) operates as an unregistered public association.
