In Chechnya, Court refuses advocate in examining case against Taramov and Tazbiev

The Staropromyslovsky District Court violated the right to defence of Magomed Taramov and Jamalai Tazbiev, sentenced on the charge of trying to leave for Syria. The violation was in the fact that the Court failed to provide the defence with the access to the criminal case before sending it to a higher court instance. This was claimed by advocate Khava Akhmadova.

The "Caucasian Knot" has reported that on September 5, the Staropromyslovsky District Court of Grozny sentenced 21-year-old Magomed Taramov and 18-year-old Jamalai Tazbiev on the charge of trying to leave for Syria. Each defendant was sentenced to five years of imprisonment in a high-security penal colony. Khava Akhmadova, an advocate of the sentenced men, and public defender Aset Malsagova were not notified of the date and time of the verdict pronouncement and they did not attend it.

Magomed Taramov and Djamalai Tazbiev, residents of the Grozny village of Krasnaya Turbina, were detained after a militants' attack on Grozny in December 2016. According to the newspaper "Novaya Gazeta", they complained of torture, and their relatives were beaten by policemen after more than 150 residents of Chechnya had requested General Prosecutor Yuri Chaika to punish the persons guilty of torture. The local residents consider the information about torture to be true.

On September 26, the Staropromyslovsky District Court sent the criminal case against Magomed Taramov and Jamalai Tazbiev to the Supreme Court (SC) of the Chechen Republic for consideration of an appeal. This was told to the "Caucasian Knot" correspondent by Khava Akhmadova, the advocate defending the residents of the Krasnaya Turbina village.

Khava Akhmadova has also added that the defence of the sentenced men had no possibility to examine the case materials.

"I got a copy of the verdict and the record of the court hearing. However, I could not examine the materials of the criminal case. The Staropromyslovsky District Court has violated the procedural order," Khava Akhmadova said.
