Complaint filed to ECtHR on kidnapping of Makhachkala resident

The disappearance in 2013 of Omar Valibagandov, a Makhachkala resident, involved law enforcers, and the investigation into the kidnapping is inefficient. This was stated in a complaint to the European Court of Human Rights (ECtHR) by lawyers of the Human Rights Centre (HRC) "Memorial" and the European Human Rights Advocacy Centre (EHRAC).

The "Caucasian Knot" has reported that on August 22, 2013, Omar Valibagandov went to his work, but did not return home. His relatives found out that on the other day, beaten Omar was brought to a hospital in Izberbash. After the medical care was rendered to him, law enforcers took him away with them to some unknown destination.

When the relatives of Omar Valibagandov addressed the police concerning his kidnapping, they were refused in institution of criminal proceedings. According to the police refusal, Omar Valibagandov wrote a letter in which he explained the incident: he allegedly shot himself by accident with a pistol, which he found on a beach, and he left the hospital voluntarily. According to the handwriting examination, the explanation letter was falsified; however, no one was brought responsibility, reports the HRC "Memorial".

In November 2013, the family members of Omar Valibagandov succeeded in seeking the institution of a criminal case under Article "kidnapping."

In the complaint filed to the ECtHR, the lawyers have pointed to violation of Article 2 (right to life), Article 3 (prohibition of torture), Article 5 (right to liberty and security), and Article 13 (right to an effective investigation) of the Convention for the Protection of Human Rights and Fundamental Freedoms.
