ECtHR obliges to pay 12,500 euros to Derbent woman for unsolved case of rape
The European Court of Human Rights (ECtHR) in Strasbourg took the side of the complainant from Derbent, who complained about ineffective investigation into the repeated rape committed by an official from the local Mayor's Office.
According to the complainant, in the period of between July 10 and July 17, 2009, she, then a 17-year-old girl, was repeatedly raped by an official from the Derbent city administration, who promised to hire her as an assistant. The complainant states that the official threatened to kill her family members if she informed anyone about what had happened, the ECtHR's website reports.
On July 21, 2009, she told her father about the incident, who filed a complaint to the law enforcement bides. On August 2, investigator refused to initiate criminal proceedings and noted that no act of rape took place, but the complainant defamed the official to hide a theft.
In the next five years, the pre-investigation activities were conducted improperly, and national courts and higher authorities failed to take adequate steps to investigate the circumstances, the ECtHR's ruling states.
Only in June 2014, the decision on the refusal to institute criminal proceedings, issued in December 2012, was cancelled. However, the criminal case has still not been instituted.
