The court dismissed the motion of the defence to disclose witness Evtukhov’s evidence on the case of Budanov’s murder

During trial on the case of colonel Yuri Budanov’s murder the defence entered a motion to disclose in the presence of the jury witness Alexander Evtukhov’s evidence he give in process of preliminary investigation in connection with inconsistencies the lawyers considered significant. The court dismissed the motion.

It should be reminded that during the session of January, 21, Evtukhov did not recognize the defendant as murderer because the shot had a “Slavic appearance”. On January, 24, it became known that Evtukhov was provided with state defense in connection with pressure allegedly brought on him by the attorneys.

During the session of January, 28, lawyer Musaev reminded that the witness did not specify the hair colour of the criminal who escaped from the scene of Yuri Budanov’s murder. “The reason why Evtukhov did not come to court was extraordinary for he was kidnapped. Besides, the court did not accomplish interrogation of the witness, so, the court and state prosecution have nothing to keep back from the jury”, defendant Temerkhanov’s attorney Murad Musaev declared.

State prosecution party had no objections against disclosure of Evtukhov’s evidence given during pre-trial investigation.

”We do not lose hope to interrogate Evtukhov in court and we will go back to this issue later”, state prosecutor Maria Semenenko said.

On the same day the motion of the defence to interrogate the representative of Committee of Inquiry was dismissed. Lawyer Murad Musaev insisted on interrogation of representative of Committee of Inquiry of the Russian Federation Vladimir Markin “as a physical person who spoke about the criminal’s appearance in mass media”.
