The Agafonovs’ defence declared their intention to appeal against the verdict to Mirzaev to ECtHR

Representatives of the family of Ivan Agafonov who died as a result of martial arts pro Rasul Mirzaev’s blow will submit a supervisory appeal to the Presidium of Moscow city court and appeal to the European Court of Human Rights asking to acknowledge the verdict to the athlete unlawful and refer the case for a new consideration.

Today Moscow city court dismissed the sufferers’ appeal declaring the verdict to Mirzaev justified. The defendant’s action was earlier reclassified from clause 111 (deliberate damnification to a person’s health resulting in death) to clause 109 of the Criminal Code of the Russian Federation (deadlier crime out of carelessness).

“The court did not mention all the evidence studied during trial in its verdict or give its detailed analyses, the judges gave no explanation why they accepted certain evidence, rejected other and qualified the defendant’s action”, the sufferers’ attorney Oksana Mikhalkina said.  

Public Prosecutor Andrey Sergeev declared that there were no violations of the sufferers’ rights during the trial.

The Panel of judges considered the arguments of Public Prosecutor’s office more ponderable and dismissed the appeals of the Agafonovs’ defence studied during the trial.
