At trial on attack on Nalchik, judge leaves defendant Zaur Tokhov in custody
Today, at the Supreme Court of Kabardino-Balkaria, at the trial on case of the attack on Nalchik, Marat Ozrokov, the advocate of defendant Zaur Tokhov, filed a motion to change the pre-trial restriction measure for his client to another form of restriction not related to detention in custody. The advocate referred to the results of the examination of the defendant's state of health and also asked the court to release Zaur Tokhov to attend the funeral of his child. The court dismissed the motion.
Marat Ozrokov has stated that the special medical commission of the Republic's Clinical Hospital, which on May 7, 2013, repeatedly examined his client, defendant Zaur Tokhov, issued an opinion, according to which the pre-trial restriction measure for Zaur Tokhov should be change for health reasons.
The advocate also reported that Zaur Tokhov's minor child was killed in a car accident, so, "it was desirable to change the pre-trial restriction measure for him namely today" so that he could attend the funeral.
At the today's court session, the judges deliberated at place and once again came to the conclusion that the physicians' opinion did not meet the requirements. "The opinion fails to indicate the category of Zaur Tokhov's disease, what kind of medical treatment he needs and what medical facility he should attend for medical treatment," stated Judge Galina Gorislavskaya, who chaired the court session.
The next court session is scheduled for May 23 in connection with the illness of advocate Shorova who came to the today's court session, according to her story, at the request of the advocate Marat Ozrokov, so he could express his motion.
