Relatives of Magomedkhabib Magomedaliev killed in Makhachkala outskirts complain his body not given out

Relatives of Magomedkhabib Magomedaliev, who was killed during the special operation, held on March 20 in the village of Semender in Makhachkala outskirts, report that the body has not been given them out for burial.

In the morning of March 20, the counterterrorist operation (CTO) regime was introduced in the village of Semender, and it was cancelled only in the evening of March 23. In the place of the special operation, the bodies of five suspected militants from the "Gimry" grouping of Ibragim Gadjidadaev, and one of the killed men was identified as Magomedkhabib Magomedaliev, Chairman of the District Assembly of the Untsukul District of Dagestan. Earlier, the source of the "Caucasian Knot" correspondent in law enforcement agencies of Dagestan explained that Magomedkhabib Magomedaliev was suspected by power agencies of having relationships with underground; however, his guilt has not been proven. One of the websites that support the Dagestani militants has reported that Magomedkhabib Magomedaliev killed in the special operation held in the village of Semender was an active member of the underground. According to the information of Magomet Murtazaliev, the head of the local executive committee of the "Edinaya Rossiya" (United Russia) Party of the Untsukul District of Dagestan, Magomedkhabib Magomedaliev was associated with crime, and many people in the republic knew about that.

Meanwhile, the relatives of Magomedkhabib Magomedaliev and some of his countrymen believe that power agents killed him groundlessly, and the residents of the village sent a collective letter to Ramazan Abdulatipov, Acting President of Dagestan, asking him to respond to the special operation held in the village of Semender.

In early April, the relatives of Magomedkhabib Magomedaliev received the letter signed by Major-General Andrei Konin, the head of the FSB Department in Dagestan, indicating that Magomedkhabib Magomedaliev had rendered armed resistance to law enforcement agents during the CTO.

A source in the Kirov ROVD (District Interior Division) that controls the village of Semender has reported that the decision to give out or refuse in giving out the body for burial is to be made at the level of the investigatory agencies.

Officials from the Investigatory Committee of Dagestan have explained the "Caucasian Knot" correspondent that they just carry out the criminal investigation.

"If we talk about the law, then, in accordance with Article 14.1 of the Law of the Russian Federation 'On Burial and Funeral Business', it is prohibited to give out to relatives the bodies of terrorists or persons suspected of involvement in committing terror acts. However, most of the persons killed in special operations are members of illegal armed formations (IAFs), and the Law does not state anything about them," said Ruslan Magomedov, an advocate from the Dagestani Advocates' Chamber, in his interview to the "Caucasian Knot" correspondent.

He also emphasizes that there is also presumption of innocence. "All those gaps allow law enforcement agents to decide by themselves whose body should be given out and whose should not. And it has been repeatedly stated that fact breeds corruption within law enforcement agencies," Ruslan Magomedov has explained.
