Strasbourg court accepted a claim from the Porfirievs family who are at law with the Administration of Astrakhan for their house

On November, 27, the Porfirievs family who are being evicted from their house in Astrakhan with their baby upon a decision of the court received an answer from the European Court of Human Rights (ECtHR) about acceptance of two first claims for processing which concern gross violation of their rights in connection with the actions of Astrakhan municipal Administration by confiscation of their house and the land where it is located.

The Porfirievs have been at law for their house in Amurskaya street, No 14, of Astrakhan, since local authorities decided to confiscate the land house where the building is located for the benefit of the city. The Porfirievs state that no agreement on the conditions of this confiscation was achieved between them and the Administration of Astrakhan and in case of eviction they have nowhere to go.

The first claim was submitted to ECtHR on December, 20, 2011, and the second one on May, 29, 2012. The first claim was about the actions of State registration, cadaster and cartography Federal Service in Astrakhan region and in the second one they complained of the decision of Sovietsky district court of disappropriation and the established amount of compensation.

According to the tenants of the disputed house, the land parcel of 3201 square meters belongs to Gennady and Elena Kornushenko as a property. Elena Kornushenko has not been living in the house in Amurskaya street since 1978 but she owns half of the building. The woman cannot protect her rights because of a poor state of health.
