MCC upholds denial of compensation to Krasnenkov from "Memorial"
Today, the Moscow City Court (MCC) has rejected the complaint lodged by Andrei Krasnenkov, the legal representative of the head of Chechnya Ramzan Kadyrov, against the decision of the Tver District Court to refuse to recover from the Human Rights Centre "Memorial" of 500,000 roubles of compensation under the case of defending the honour, dignity and business reputation.
Mr Krasnenkov had filed a civil suit against the HRC "Memorial" in late 2010 in the context of the article "Ramzan Kadyrov's Lawyer Misleads Journalists" posted on the HRC's website on September 30. According to the claimant, the article contained "slanderous fabrications." The proceeding was suspended on February 14, 2011, at the claimant's request. On July 4, 2012, the Tver District Court of Moscow dismissed the action.
On November 14, the Board of Appeals on Civil Cases of the MCC upheld the legality of denial of compensation of 500,000 roubles from the "Memorial" under the case on protection of honour, dignity and business reputation.
Also, the MCC did not oblige the HRC to publish a refutation of the contested facts contained in the above article. The Court has found the arguments, provided in Andrei Krasnenkov's complaint unjustified, and upheld the decision of the Tver Court.
