Defendant in Nalchik attack case petitions on returning the case to public prosecutor
Today, at the session of the Supreme Court of Kabardino-Balkaria on the criminal case about the events on October 13, 2005, the parties in the process discussed the petition filed by defendant Azamat Akhkubekov in favour of returning the criminal case to the public prosecutor, since, in his opinion, there are significant discrepancies between the indictment and the materials of the criminal case.
The defence has supported the petition. Advocate Lanevskaya came out with an assumption that, possibly, during this time someone of the defendants will be amnestied.
The state prosecution was against, arguing that according to the Code of Criminal Procedure of the Russian Federation, the case is returned to the public prosecutor only if the revealed discrepancies cannot be eliminated in the course of litigation.
The court has rejected the petition "for absence of remedial grounds for returning the materials of the criminal case to the public prosecutor."
