Ingush court refuses to re-qualify Evloev's death into murder

The Sunzha District Court of Ingushetia has refused to re-qualify the criminal case on the fact of death of Magomed Evloev, owner of the website "Ingushetia.Ru", from Article "Causing death by inadvertence" into Article "Murder".

"The Court has considered the complaint of the victims' defence and refused to re-qualify the criminal case, finding lawful initiation of the case under Article 109 ("Causing death by inadvertence") of the Criminal Code," Musa Pliev, advocate of the suffered family, has reported today.

"We've nothing more to do but apply to the European court. We still have to exhaust the cassation instance, but I think it'll be just a formality," he has added.

We remind you that Ibragim Evloev, head of the guard of the Ingush Interior Minister, accused of occasional murder of Magomed Evloev, was released under recognizance not to leave.

The "Kommersant" writes that inspector Mikhail Komarov has confirmed that one of the militiamen who had taken part in detaining the oppositionist, was charged under Article 109 of the Criminal Code ("Causing death by inadvertence": up to three years of imprisonment). Mr Komarov refused to give the name of the accused person; however, it was disclosed on October 8 by the advocate of the family of the assassinated oppositionist.

The "Caucasian Knot" has already informed that the information about presenting charges to Ibragim Evloev was confirmed by Kaloy Akhilgov, advocate of the Evloevs. However, another advocate for the suffered family, Musa Pliev, has noted that Ibragim Evloev is not victim's relative. He has also noticed that the customers of the murder are "absolutely different people."

The lawyer has also drawn attention to the fact that delivery of Magomed Evloev to the interrogation was performed not by usual militiamen, but by the guards of the Minister of Internal Affairs of Ingushetia. In Mr Pliev's opinion, the fact that Minister Musa Medov sent his securities (who are his relatives, by the way) to pick up the oppositionist can evidence that they had initially planned not to detain Evloev but to liquidate him.

The GZT.ru portal marks that for Magomed Evloev's colleagues charging Ibragim Evloev was no surprise. Just a couple of days after Magomed's death they placed on the Internet their list of the persons involved in the murder, where Ibragim Evloev, who had left his service at the MIA some days after Magomed's death, was mentioned among direct executors of the crime.
