Prosecutor's Office of Kabardino-Balkaria reveals violations of orphans' rights

The Public Prosecutor of the city of Nalchik, the capital of the Kabardino-Balkarian Republic (KBR), has addressed the court with 47 claims in the interests of 51 children, remaining without parental care, on violation of their right, stipulated by the federal legislation, on extraordinary provision of housing facilities.

According to the Prosecutor's Office, the list of children-orphans in need of housing compiled by the administration of Nalchik comprises 88 persons.

In 2008, the KBR's Government planned to allocate 8 apartments for children-orphans in the built 220-apartment house. However, the Republic's budget for 2009 did not assume any funds for this purpose.

The check has established that the State Public Health Institution (SPHI) "Children's Home" and the State Institution SI "Nalchik Children's Boarding School for Mentally Retarded Children" of the KBR's Ministry of Labour and Social Development are housing 43 children-orphans on complete state maintenance.

"In violation of the law, none of the children was duly registered, which in future will entail violation of their housing rights," said a source in the press service of the KBR's Prosecutor's Office.

"In the SI 'Nalchik Children's Boarding School for Mentally Retarded Children', none of the minors was registered as a person in need of housing, no measures were taken to establish any real estate that they can possess, no alimony was collected from parents in favour of minors, and no grounds were established for appointing allowances to them," the source from the press service has added.

The Prosecutor's Office asks the court to oblige the administration of Nalchik to provide housing to the above children.
