Dagestan court finds non-admission of advocate to detainee in the special operation illegal

On April 14, Federal Judge of the Kirov District of the city of Makhachkala Yaguzar Magomedov found illegitimate the actions of the employees of the IVS (temporary custody facility) at the ROVD of Makhachkala who did not admit advocate Abakar Aliev to his client Ahmed Aliev, detained in the course of a special operation, referring to the order of Rasul Gazimagomedov, head of the GUVD, about special regime.

The advocate told the "Caucasian Knot" correspondent that his client was detained on February 21 in the course of a special operation in his own house together with his senior brother Nurmagomed and his friend Dzhamaludin Aliev. Under the version of power agents, the pretext for arrest was the detainees' links with militants and a high power explosive detected in the shed, which was allegedly immediately liquidated in situ.

On that very day, the detainees were brought to the Sovietskoe ROVD of Makhachkala. Law enforcers started to beat Ahmed and Dzhamaludin back in their house, numerous neighbours were eyewitnesses.

Nurmagomed was released in a day. He said that militiamen continued to beat his brother in the ROVD building, and Ahmed Aliev was tortured with electric current.

On February 23, the detainees were removed to the Makhachkala IVS. Dzhamaludin Aliev managed to meet advocate Abdul Magomedov, who later reported that his client was still tortured. "He had bruises and grazes on his head, neck, between teats, and finger phalanxes had characteristic burns. I fixed all that in a complaint submitted to the inspector," said the advocate.

Ahmed Aliev was not allowed to meet his advocate, allegedly because of the special regime introduced by Rasul Gazimagomedov, head of the GUVD of Makhachkala. Abakar Aliev has stated that his non-admission to the client could be explained by the desire of power agents to obtain the required information and protract time to conceal torture traces.

On February 27, Abakar Aliev lodged a complaint to the Kirov District Court and Prosecutor's Office of Makhachkala against militiamen's wrongful actions. On February 28, he managed to meet his client. Ahmed Aliev told his advocate that in the first days he was severely beaten by three persons of Slavic appearance in camouflage.

In a week, Abakar Aliev received a letter from the Prosecutor's Office stating that militiamen acted within the bounds of the law. He told the "Caucasian Knot" correspondent that he wanted to repeatedly address the Prosecutor's Office of Dagestan with a request to make responsible particular employees of the IVS under the GUVD of Makhachkala, who prevented the advocate to meet his client.

The GUVD of Makhachkala said that complete isolation of a detainee is a lawful act, as in relation to Ahmed Aliev "a special regime can be introduced for the period of 10-15 days because of available operative information."

Nadira Isaeva, editor-in-chief of the Dagestan weekly "Chernovik", has expressed her opinion that power agents try to knock out through physical pressure evidences against the newspaper, since sister of Arthur Mamaev, editor of the information-political section, is Ahmed Aliev's wife, and the special regime was introduced for hiding the fact of torturing the detainee.
