Relatives of incapacitated tourist complain to Kuban Prosecutor about his rights violation

Galina Teryokhina, a Moscow resident, has sent a complaint to the Public Prosecutor of the Krasnodar Territory (also known as Kuban by the name of the main river) that the court had fined her incapacitated relative for sneaking onto a fenced beach. The fine should be cancelled, since according to the law, an incapacitated person is not subject to administrative liability, a lawyer has noted.

The "Caucasian Knot" has reported that on June 13, residents of the town of Anapa told about a conflict with the bosses of a local children's camp, who, according to their version, had fenced off the beach and deprived townspeople of access thereto. Galina Teryokhina, a tourist from Moscow, said that law enforcers had detained her son-in-law's father, the 57-year-old Dmitry Lozner, who is dumb, for trying to enter the fenced beach. He was taken to court, where he was fined. Teryokhina was outraged by the fact that the court ruling had stated that Lozner allegedly gave evidence, although he is a mute disabled person. She has also complained that Lozner was tried without an advocate.

Galina Teryokhina treats law enforcers' actions as an abuse of their official powers, discrimination against a disabled person, while the judge's actions fall under the article "Passing a knowingly unjust judicial act" (provides for up to 10 years of freedom deprivation, – note of the "Caucasian Knot"). The woman from Moscow has asked the Prosecutor to defend the incapacitated disabled person, since he cannot himself defend his rights.

Galina has pointed out that in 2019, Lozner suffered a cerebral infarction and lost his speech; he cannot read and write, and sometimes understand one's speech addressed to him. Doctors recommended that he relax by the sea, but this year the beach was fenced off.

According to her story, Lozner had no intention of penetrate into a security facility; he wanted to relax with his children on a wild beach. Neither he nor his family saw any forbidding signs. Even if Lozner had seen them, he would not have been able to read them due to his incapacity. In their turn, law enforcers believed that Lozner was drunk.

Teryokhina also has criticized the bosses of the children's camp, who had fenced the beach off, and drew attention to the armed guards deployed there.

Roman Klykov, a lawyer, has noted that according to the law, the judge had no right to pass a liability ruling against an incapacitated person.
