Victim of beating by militiamen gets moral damage compensation in Kabardino-Balkaria

The Nalchik City Court has passed a decision to partially satisfy the claim lodged by Khamidbi Apshev, a resident of Nalchik, the capital of Kabardino-Balkaria, and to collect 30,000 roubles from the state treasury in favour of the claimant as indemnification of his moral damage.

Khamidbi Apshev was beaten by Alchagirov and Badalov, employees of Interior Department No. 2 of Nalchik on November 6, 2001. The fact of his bodily injuries was established and registered.

The pre-trial check is still conducted on his application. Statements to reject initiation of a criminal case were passed 25 times, and cancelled exactly the same number of times.

Mr Apshev lodged his suits against the Ministry of Finance of the Russian Federation (RF), the RF State Office of Public Prosecutor, the Prosecutor's Office of the Kabardino-Balkarian Republic (KBR), the Prosecutor's Office of the City of Nalchik, the KBR Ministry of Internal Affairs and the Nalchik City Department of Internal Affairs. He estimated the moral damage caused to him by the above bodies to be one million roubles.

The Court has partially satisfied the claims, having recognized that Apshev's application for protection of his broken rights was not resolved within more than five years, which is a breach of Article 13 of the Convention on Protection of Human Rights and Fundamental Freedoms.

  • Two natives of Northern Caucasus injured in shootout near “Wildberries” office in Moscow

    A shootout took place near an office of the “Wildberries” Company in the centre of Moscow. As a result, at least one person has been killed and several others have been wounded, sources report.   • In Volgograd, court recognizes absence of HIV therapy in prison hospital

    The Central District Court of Volgograd awarded prisoner Ruslan Mitrofan compensation in the amount of 1000 roubles, recognizing that the administration of a prison hospital in Volgograd violated the prisoner’s right to receive medical care by not providing him with an HIV medicine. Meanwhile, Ruslan Mitrofan requested the compensation in the amount of 100,000 roubles.
