Advocate Mikhail Benyash* succeeds in removing marking of a foreign agent

In Krasnodar, a court suspended the decision of the Russian Ministry of Justice to include advocate Mikhail Benyash* in the register of foreign agents. Now he may not mark his publications as a foreign agent, and this may also affect the possibility of his participation in the case of Kuban fighters of the “Rosgvardiya” (National Guard of Russia), who were dismissed after refusing to participate in the special military operation in Ukraine.

The “Caucasian Knot” has reported that on October 28, the Russian Ministry of Justice (MoJ) included Mikhail Benyash * in the register of individuals-foreign agents, and the advocate filed an appeal against the MoJ’s decision. On December 13, it became known that a court in Sochi removed Mikhail Benyash from participation in the case of the dismissed fighters of the “Rosgvardiya”, stating that being a foreign agent, Mikhail Benyash* should have no access to any state secrets.

After being included in the register of foreign agents, Mikhail Benyash * tried to challenge the MoJ’s decision, but his lawsuit was left without progress for a long time.

The advocate hopes that he will be able to prove that the officials of the Ministry of Justice, who put him on the list of foreign agents, were wrong and that, following the results of the proceedings, he will no longer have to put the marking of a foreign agent on his own publications.

The Department of the Russian Ministry of Justice for the Krasnodar Territory stated that Mikhail Benyash* undermined the status of the advocates by posting on his Telegram channel “incorrect statements” in relation to the authorities, which is incompatible with the status of an advocate.
