Court obliges Prosecutor’s Office to eliminate violations in case on Djabiev’s death

The Tskhinvali City Court returned the case on the death of Inal Djabiev to the Prosecutor’s Office and demanded to eliminate the violations in it. Part of the information indicated in the case file was not confirmed in the indictment, a lawyer of the Inal Djabiev’s widow explained.

The “Caucasian Knot” has reported that on July 7, the court prolonged for two months the term of arrest of two defendants in the case on the Inal Djabiev’s death – Atsamaz Naniev and Alan Bagaev.

Seven law enforcers were accused for Djabiev's death; and Andrei Tskhovrebov, a Deputy MIA head, was removed from office.Djabiev's death sparked massive protests and a political crisis in South Ossetia.

Today, the Tskhinvali City Court has granted the motion filed by the lawyer of Oksana Sotieva, the widow of Inal Djabiev, and pronounced a decision to return the case on the Inal Djabiev’s death to the Prosecutor’s Office for elimination of the violations. The lawyer has explained that the materials of the criminal case contained violations of the Code of Criminal Procedure. In particular, the materials say that the Inal Djabiev’s death was ascertained by doctors who arrived, but “the materials of the indictment did not contain the information of which doctors and in which building ascertained the death of Inal Djabiev,” the lawyer pointed out.

In turn, the defence of the defendants and the defendants themselves opposed the return of the criminal case to the Prosecutor’s Office. However, the court has pronounced a decision to return the case to the Prosecutor’s Office and noted that in the indictment, the investigator indicated the time of the crime as coinciding with the time when the Inal Djabiev’s death was ascertained. Besides, according to the court’s decision, Alan Bagaev and Atsamaz Naniev remain in custody, and the other five defendants stay under recognizance not to leave, the “Res” news agency reports.
