ECtHR awards compensation to resident of Chechnya for his wound during CTO

The European Court of Human Rights (ECtHR) has found a violation of the right to life of a Chechen villager, who was wounded by law enforcers during a counterterrorist operation (CTO). Russia is obliged to pay EUR 40,000 in compensation for his suffered moral harm.

The ECtHR has ruled on the complaint "Shirvaniev versus Russia". The complaint lodged by Kuri Shirvaniev, a civilian resident of the village of Selmentauzen, Vedeno District of the Chechen Republic, concerned his severe wound by militaries in 2016. As a result of the wound, he became a Category II invalid. The perpetrators were never brought to justice. The ECtHR found a violation of Article 2 (right to life) of the European Convention on Human Rights (ECHR), says the statement posted on the ECtHR's website.

Russian failed to show that the lethal force used that resulted in the claimant's wound was absolutely necessary. Shirvaniev claimed EUR 75,615 in compensation for his moral harm; the ECtHR awarded him the compensation of EUR 40,000, and ordered Russia to pay it within three months, according to a press release of the ECtHR.
