ECtHR obliges Azerbaijan to pay EUR 30,000 to Arthur Badalyan
Azerbaijani authorities have violated the prohibition of torture and the right of Arthur Badalyan, an Armenian soldier, to freedom and personal immunity during his captivity, and must pay him 30,000 euros in compensation, the European Court of Human Rights (ECtHR) has stated.
The "Caucasian Knot" has reported that on March 17, 2011, Azerbaijan handed Arthur Badalyan, an Armenian citizen, over to the Armenian party. In mid-August 2011, Badalyan appealed to the ECtHR with a complaint of "inhuman treatment and torture" after his capture.
The ECtHR has finished considering Arthur Badalyan's case and obliged Azerbaijan to pay him 30,000 euros in compensation for non-material (moral) harm, says the message posted on July 22 on the ECtHR's website.
The ECtHR has recognized that Azerbaijan had illegally kept Arthur Badalyan in captivity, failed to provide information about the place and conditions of his custody for the entire period of captivity. The ECtHR has also upheld the arguments of the Armenian Government, involved in the case as a third party, and recorded that Azerbaijan had violated the provisions of Article 5 of the European Convention on Human Rights (ECHR), which guarantees a person's right to liberty and personal immunity.
Also, the ECtHR has fixed violations of Article 3 of the ECHR that prohibits torture.
