Lawyers criticize position of Azerbaijani MoJ in case of separation of girl from her family
According to the Azerbaijani State Committee for Family, Women and Children Affairs, the court enforcement action on separation of a 10-year-old girl from her aunt, who brought up the child, and transfer of the girl to her father do not meet the interests of the child. A new trial will be held. Lawyers claim the girl has experienced a lot of stress because of the negligence of officials.
The "Caucasian Knot" has reported that in the Guba District in Azerbaijan, court marshals used force to separate a 10-year-old girl with her aunt Mekhriban Eldarova, who brought up the child. According to Ombudsman Elmira Suleimanova, the separation violated the rights of the child. The girl said she wanted to live together with her aunt and that she first saw her father at a trial and she was afraid to live together with him.
The girl's aunt said that the father left his daughter when she was an infant.
Azerbaijani MP Vakhid Akhmedov has confirmed that the girl lost her mother when she was an infant and that she was brought up by her aunt.
According to Alesker Mamedli, an expert in the field of law, a member of the public association "Civil Society Platform", the court marshals "acted unprofessionally and inflicted to the girl moral and physical pain by dragging her on the floor."
Alesker Mamedli has also condemned the actions of judges. According to him, the fact of biological paternity is not a reason to separate a child from a person who was bringing up the child during 10 years.
Avaz Bairamov, the father of the child, told the agency "APA" that after the death of the child's mother he wanted to see his daughter, but the child's aunt prevented his intentions and so he went to court.
