Defence of journalist Fikret Faramazoglu is drafting complaint to the ECtHR

On October 28, the Azerbaijani Court of Appeal (CoA) rejected the complaint against the extension of the arrest of the journalist Fikret Faramazoglu. His defence now intends to apply to the European Court of Human Rights (ECtHR).

The "Caucasian Knot" has reported that Fikret Faramazoglu was placed in custody on charges of extortion. His advocate has stated that Faramazoglu had confessed under torture.

On October 28, the Baku CoA, chaired by Judge Jamal Ramazanov, considered the above complaint.

"Unfortunately, the consideration lasted just a few minutes; and the court, while ignoring our arguments that the inquiry could go on without keeping Faramazoglu in custody, because of his dependent young children, has rejected the complaint. Yesterday (on October 28), at the CoA, Judge Gail Mamedov considered our petition to change Fikret's freedom restraint from custody for house arrest. It was also rejected," said the advocate.

He added that now the defence will apply to the ECtHR asking to recognize the violation of Faramazoglu's rights under Articles 5 (right to liberty and personal immunity), 10 (freedom of expression) and 18 (limits of restricting one's rights) of the European Convention for Human Rights and Fundamental Freedoms (ECHR).
