Court refuses residents of Dagestani village of compensation for destroyed houses

On June 15, the Tver Court of Moscow dismissed the claim for compensation in favour of residents of the Dagestan village of Mekhelta for their houses destroyed by natural disaster. The Court has recognized the Russian Ministry of Finance as improper defendant.

The "Caucasian Knot" has reported that on March 23, an official of the Russian Ministry of Finance asked the Court not to consider the claim. The official has referred to the fact that the Ministry of Finance had got no materials on the emergency and that the deadline for filing claims had already passed.

For ten years, Alimirza Alimirzaev, Saigitaga and Shayikhmagomed Shayikhmagomedov try to obtain compensation for their housing destroyed as a result of landslides and rains. The authorities of Dagestan claim no federal funds for compensation.

According to advocate Sapiyat Magomedova, the claim was dismissed, since in this case, the proper defendants are the government and the Ministry of Finance of Dagestan.

The advocate has also noted that earlier, the Soviet Court of Makhachkala, which had been addressed by complainants yet in 2012, had sent the case for consideration to the Tver Court of Moscow, located at the place of the defendant, i.e. the Russian Ministry of Finance.
