Dagestani resident demands compensation for criminal prosecution

Khabib Budaikhanov, a Dagestani resident, who was sentenced to imprisonment and the verdict of guilty against whom was cancelled in five years, filed a lawsuit demanding compensation for damages in the amount of 1 million roubles.

On July 4, 2008, Khabib Budaikhanov, a resident of the city of Khasavyurt, was detained on suspicion of committing a robbery. On October 9, 2008, the Khasavyurt City Court pronounced the verdict to sentence Khabib Budaikhanov to one year of conditional imprisonment with probation period of 10 months. This was told to the "Caucasian Knot" correspondent by Murad Imanshapiev, an advocate from the Dagestani Advocates' Chamber, representing the Khabib Budaikhanov's interests.

The verdict of guilty was challenged, and on June 19, 2013, the Presidium of the Supreme Court of Dagestan has pronounced the decision to cancel the verdict.

"I was kept in custody from July 4 till October 9, 2008, more than three months, and after that I was sentenced to a one-year of conditional sentence and 10 months of probation. I have had a criminal record for more than five years. The very fact of unjustified criminal prosecution on charges of committing a serious crime had a negative wide public resonance," Khabib Budaikhanov told the "Caucasian Knot" correspondent.

He has added that the pronounced verdict of guilty humiliated and insulted all his family members.
