ECtHR upholds lawsuit of Chechen woman against Russia

The European Court of Human Rights (ECtHR) upheld the complaint filed by the Chechen woman-resident Gizhan Sambieva, the mother of Said-Emin Sambiev, who had been kidnapped and murdered in 2003. The ECtHR has obliged the Russian Federation to pay her compensation.

Gizhan Sambieva claims that in 2003 her son had been kidnapped by Russian servicemen and then murdered. Sambiev worked at the security service of the Chechen President; on August 13 he drove in a taxi with his colleague, in the Vedeno District they were stopped by soldiers and brought to the base complex of airborne regiment.

On August 24, Madjidov, severely beaten, was released. On that day he had seen Sambiev, who had been barely alive from the beating. Since then, Said-Emin Sambiev was on the list of missing persons.

The criminal case instituted by the prosecutor's office of the Vedeno District on the fact of Sambiev's disappearance, was not solved, the "skfonews" reports.

According to Gizhan Sambieva, Russian authorities failed to conduct the proper investigation of her son's disappearance, law enforcement agencies failed to respond to her complaints. The woman-resident of Grozny also claims that her son's disappearance severely affected her financial position and health, the "bfm.ru" reports.

The ECtHR in Strasbourg has ruled that in her case Article 2, 3, 5, and 13 of the European Convention on Human Rights ("Right to Life", "Prohibition of Torture", "Right to Freedom and Security of Person", "Right to Effective Remedy") have been violated and Russia is to pay a fine of about 67 thousand euros to Gizhan Sambieva, the ECtHR's website reports.
