Re-trial on teenager's beating in Dagestan returns case to prosecutor

On October 18, the District Court of the Shamil District of Dagestan held a session on the case of teenager's beating. The figurants in the case were three police officers of the Police Division of Shamil District of Dagestan. The court decided to remand the criminal case to the prosecutor for a more complete and objective investigation.

The court order dated October 18 indicates all violations of procedural rules.

In particular, it states that at the time when the criminal case against Magomed Magomedov was initiated, two other police officers - Magomedaliev and Nurudinov - were known to be the participants of the incident; however, criminal case against them was not instituted.

Panel of judges revealed that, in the indicated criminal case, the preliminary investigation body committed substantial violations of the procedural criminal law, of rights and legitimate interests of the defendants, which were not eliminated during the trial.

The court also ruled to return the case to the prosecutor of Khunzakh District to eliminate all violations of procedural provisions, committed during the legal proceedings.

The court upheld pre-trial restrictions the defendants in the form of recognizance not to leave and good behaviour.
