The court declined a lawsuit of a resident of Volgograd who demanded recurrence of direct election of Head of the city

Volgograd regional court dismissed the case on the lawsuit of Alexander Galuzo who demanded adoption of the decision of announcement of direct election of Head of Volgograd.

Galuzo declared in court that the all-out direct election had been canceled unlawfully and asked the court to fix the date of its holding referring to Federal Law “On the Guarantees of the Citizens’ Constitutional Rights” which allowed a judgment in case of violation of these rights.

Representatives of Volgograd Administration and municipal Duma, on the contrary, insisted that there were no reasons for fixing general election for the changes to the Charter were legitimate and established a new order of elections of the management, “Commersant” reports.

The judgment of dismissal of the case was based on clause 248 of Code of civil procedure which stipulates that a judge has the right to reject a lawsuit or dismiss a case emerging from public legal relationship if there already exists a judgment brought on an appeal on the same subject which has come into effect.

Earlier, a similar lawsuit was submitted to court by resident of Volgograd Zhuravlev. The Supreme Court rejected his appeal referring to Press service of Volgograd regional court, web-site "V1" reports.
