In Makhachkala, court requests documents on distance from Russian Cemetery to residential blocks in construction

Today, the Kirov Federal Court of Makhachkala has held the first session on the claim of the local prosecutor's office about illegal construction of residential blocks near the so-called "Russian Cemetery".

As reported at the session by Madina Gadjimuradova, senior assistant of the public prosecutor of Makhachkala, the Office had received a lot of appeals from both citizens and public organizations of Dagestan and other regions of the country, where people expressed their protest against the construction of residential blocks in close vicinity from the Russian Cemetery. According to her story, according to the law, the sanitary zone from the cemetery fence to dwelling houses should be at least 300 meters wide. However, as she added, regions have the right to adjust this figure.

"The government of Dagestan passed a statement under which for the traditional burial cemeteries, which have the area of less than 10 hectares, the distance from the cemetery fence to the houses should be 100 meters; for the cemeteries larger that 10 hectares – at least 300 meters," said Madina Gadjimuradova.

Shamil Kharkharov, who represented one of the developers named Kurachev, explained to the court that all the 12 future residents of the new house have no claims as to the location of the house near the cemetery. According to his story, "the wall that faces the cemetery has no windows; they were moved to the facade side."

Judge Sergey Miroshnichenko asked the parties to present to the next session, to be held on July 19, the expert's conclusion on the allowed distance between the cemetery and residential blocks.
