UN Court refuses to consider Georgia's claim to Russia
The Hague Court (the UN International Court of Justice) has decided that it has no jurisdiction to consider the claim of Georgia versus Russia, in which Georgia accuses Russia of non-fulfilment of the International Convention on Elimination of All Forms of Racial Discrimination.
The "Caucasian Knot" has reported that Georgia had filed suits against Russia at the International Criminal Court (ICC) and the International Court of Justice (ICJ) in August 2008. She finds Russia guilty of ethnic cleansings in the period from 1993 to 2008, and forced displacement of 300,000 persons in August 2008.
On September 13-17, 2010, The Hague held a public hearing on Georgia's suit to Russia. Russia insisted that the ICJ had no jurisdiction over this suit and asked to stop the case, saying that Moscow had no dispute with Georgia on this issue.
The Hague International Court of Justice upheld one of Russia's petitions and decided not to consider the Georgia's claim against Russia on the merits, the "Sivil.ge" reports.
As stated by Judge Hisashi Owada, Chairman of the Court, at the public meeting in The Hague on April 1, the Court had found that "it has no jurisdiction to consider the suit brought in by Georgia on August 12, 2008."
The Court's decision was made by the 10:6 majority.
