Resident of Ingushetia convicted in Stavropol on forged claim, relatives say
Relatives of Idris Albogachiev, a resident of Ingushetia, convicted on December 12 for violating disciplinary regulations in a corrective establishments in the Stavropol Territory, told the "Caucasian Knot" correspondent that Idris fell victim to inspectors' and judicial arbitrariness.
Idris Albogachiev was serving his term in the Corrective Colony IK-6, located in the territory of Dadymkin Hamlet of the Stavropol Territory, under his initial verdict. On December 12, he was to get at large after expiry of his term, but was convicted again by the Kursk District Court under part 2, Article 321, of the Criminal Code of the Russian Federation (disorganization of the work of establishments enforcing isolation of offenders from the society), and sentenced to two years of imprisonment.
"The fact that Idris was convicted on that very day, when he should have regained his liberty, is not a coincidence. Deputy Chief of IK-6 Kinasov is taking revenge on Idris for his convicted brother, a former colony employee, sentenced for murdering the prisoner, who was Idris' friend. Kinasov repeatedly threatened Idris, promising to rot him in prison," one of Albogachiev's relatives told the "Caucasian Knot" correspondent.
The relative asserts that Kinasov used the incident that happened in the colony in July this year as a pretext to convict Albogachiev. Under the version of the prosecution, Albogachiev banged Kinasov up. Albogachiev asserts that there was no beating.
Ilias Yarizhev, Albogachiev's advocate, told the "Caucasian Knot" correspondent that "the investigation and trial were biased, one-sided and held with rough violations. The court passed the verdict of guilty on the basis of evidences of two colony employees and Kinasov himself, having not interrogated the real witnesses, who were present in Kinasov's study on that day. Out of 15-20 inmates, only five were interrogated, and their evidences were not taken into account," said Mr Yarizhev and added that he had lodged a cassation complaint to a higher instance - the Regional Court.
