Dagestan resident complains of illegal actions of the militia

Abdulbadyr Abdulzhaparov, a resident of Rakhata village, Botlikh District Dagestan, has addressed his complaint against Labazan Derbishev, head of the criminal investigation division of the Botlikh ROVD, to Interior Ministers of Russia and Dagestan Rashid Nurgaliev and Ali Magomedov. Mr Abdulzhaparov believes that he has fallen victim of the militiaman's persecution because of aversion.

He said to the "Caucasian Knot" correspondent that "on August 16, he was in Makhachkala with his wife. After coming home, he learnt that his house was attacked by law enforcers, who failed to present any documents, behaved violently, and forced his son-in-law Khaibula Khaibulaev to the Botlikh ROVD, where he was strongly beaten.

Khaibulaev later said that he was thrown into the car; they took away his mobile phone, and at the Botlikh ROVD Derbishev started beating him.

At night, the detainee felt bad, and they had to call a doctor. In the morning Khaibulaev was brought to the court, where acting magistrate judge of the Botlikh District, former boss of the district ROVD, Dzhalaludin Nabiev in 30 minutes passed a ruling to fine Khaibulaev by one thousand roubles for an alleged administrative offence.

Labazan Derbishev threatened that the incident with Khaibulaev and Abdulzhaparov would surely have a continuation.

On that very day, Khaibulaev filed an application to the investigatory department of the Botlikh ROVD. In the evening, Abdulzhaparov's house was again visited by militiamen with a dog led by Derbishev. Again, they had no search warrant on them.

Derbishev showed his subordinates the place in Abdulzhaparov's kitchen garden, where they should dig. Soon they found a hideout with three grenades, AKM sub-machine magazines and machine-gun belts.

One of the witnesses, Askhabali Saipudinov, an employee at the Civil Registry, has confirmed what Abdulzhaparov had said and repeated to the "Caucasian Knot" correspondent that it was clear that the ordnances had been hidden there right on the eve, in haste, at a small depth.

Abdulzhaparov asserts that the ordnances were planted there by Derbishev; the conflict with him started on July 10. On that day, in Rakhata village, Abdulzhaparov's neighbour was killed, and he was called to the Botlikh ROVD for interrogation. In the course of it, Derbishev entered the room. With a shout "you'll tell us everything" he set at Abdulzhaparov, struck his face and broke a rib.

The victim addressed immediately the Botlikh Central District Hospital and filed complaints to respective instances. Abdulzhaparov believes that Derbishev is taking revenges. "Local militiamen came to me and prompted to recall my complaints, saying that we'd have to live on together and what for I needed it. I'll never recall them, as such person like Derbishev should not work in the militia," Abdulzhaparov said.

The correspondent failed to receive any detailed comments at the Botlikh ROVD; he was only told that Abdulzhaparov's complaints had been sent to Makhachkala; and Zainudin Magomedov, public prosecutor of the Botlikh District asserts that so far everything goes within legal bounds.

"I know nothing about the incident on August 16; and on August 17 militiamen made no violations. Yes, they had no search sanction, but in exclusive cases militiamen can make such decisions independently," the prosecutor said.
