Dagestani SC refuses to treat suspension of trial against law enforcers as illegal

Musa Aliev, a resident of the village of Mutsalaul, has demanded to treat the suspension of the trial against the law enforcers who had beaten him up during his detention within a rape case as illegal. The Supreme Court (SC) has upheld the suspension, citing the fact that one of the accused had gone to the special military operation (SMO) in Ukraine.

The "Caucasian Knot" has reported that Musa Aliev had claimed that law enforcers beat him on the legs, back and face, and also put him into a "stretch" position and kept him in that position for more than an hour. According to Aliev, he was forced to incriminate himself, but he didn't do it. As a result of the received traumas, Aliev suffered a brain concussion.

Musa Aliev, like the girl's two cousins, figured in a case of rape of a minor. Aliev treats his criminal prosecution as revenge for his complaint against law enforcers. According to his wife, after filing a complaint about torture, the family received threats from policemen. A year later, the girl admitted that she had falsely accused Musa Aliev and several other villagers of raping her. The girl and her parents fear pressure from law enforcers; human rights defenders have helped them leave Mutsalaul.

Musa Aliev has appealed against the ruling of the Khasavyurt City Court to suspend the consideration of the case against the law enforcers who had been accused of exceeding their official powers with the use of violence.

The Dagestani SC has concluded that one of the defendants, Yusup Magomedov, has been serving under a contract since January 26 and was "sent to carry out the missions of the SMO."
