Court dismisses Gasanguseinov's complaint against investigators

Murtazali Gasanguseinov did not achieve in court the cancellation of the fourth investigators' refusal to prosecute the law enforcer, who reported about the killing of two Dagestani shepherds.

The "Caucasian Knot" has reported that Murtazali Gasanguseinov, a father of the killed shepherds, succeeded in seeking the institution of a criminal case on the murder of his sons. The father demands to bring the guilty law enforcers to justice. A series of November 2019 pickets held by Murtazali Gasanguseinov resulted in a disciplinary action against the chief of the ROVD (District Interior Division), who reported about the killing of the Gasanguseinov brothers as two militants, but no criminal case was instituted against the police officer.

Nabi, 17, and Gasangusein, 19, Gasanguseinov were killed on August 23, 2016, during an operation in the Shamil District of Dagestan. Law enforcers declared them to be militants, but their fellow villagers wouldn't agree with this.

On December 9, a judge of the Sovetsky District Court of Makhachkala dismissed the complaint filed by Murtazali Gasanguseinov about the fourth investigators' refusal to prosecute the ROVD chief.

While commenting on the decision pronounced by the Sovetsky District Court of Makhachkala, Abubakar Yangulbaev, a lawyer of the Committee against Torture (CaT), who represents the Murtazali Gasanguseinov's interests, said that the judge artificially withdrew himself for far-fetched reasons from solving the claim.

Abubakar Yangulbaev intends to appeal against the decision of the Sovetsky District Court of Makhachkala and send a complaint against the Dagestani law enforcers for delaying the case for bureaucratic reasons to the Russian General Prosecutor's Office and the Investigating Committee of the Russian Federation (ICRF), the newspaper "Chernovik" (Draft) reports today.
