Court releases seriously ill resident of Dagestan
Magomedsaid Gazaliev, a Dagestani suffering from cancer, will be able to leave the colony for home in ten days, his advocate has announced.
Earlier, the court demanded to provide the results of the repeated medical examination of the convict, which confirmed that he has cancer.
In November 2006, Magomedsaid Gazaliev was sentenced to 16 years and 9 months in prison on charges of attempting on law enforcers' lives. He is serving his term in the Komi Republic of Russia. Doctors diagnosed Gazaliev with cancer, but the local court refused to release him. The Supreme Court sided with the convict.
Anna Bezsherstaya, an advocate, has noted that her client had been suffering from a fourth-stage cancer for about two years. The disease is included in the decision of the Russian government dated February 6, 2004, suggesting the release of such convicts.
The advocate has added that the release day coincided with Gazaliev's birthday, who turned 55 years old.
In March 2019, Gazaliev, his mother and two sisters filed a complaint with the European Court of Human Rights (ECtHR) after the Komi City Court refused to release him.
