Azerbaijan: advocates of Intigam Aliev seek for his medical examination

After they met today their client at the Baku SIZO-1 (pre-trial prison), the advocates of the rights defender Intigam Aliev have decided to petition about his medical examination. They explained that the measure of his freedom restriction may be softened for medical reasons, confirmed by an examination.

The "Caucasian Knot" has reported that Intigam Aliev, the head of the NGO "Legal Education Society", was detained on August 8 and accused of tax evasion, abuse of office and illegal entrepreneurship. On October 24, his arrest was extended until February 8. 2015.

"Aliev received his hospital treatment due to problems in his cranial area. His arrest and detention in SIZO may have exacerbated these problems. He suffers from insomnia," said Elton Guliev, one of the advocates.

The advocate has stressed that the Code of Criminal Procedure (CCP) provides for two instances, when the investigator or the prosecutor may cancel the freedom restrictive measure in the form of arrest imposed by the court, namely: a medical conclusion about the impossibility to keep the defendant in custody because of a grave illness, or a statement about the qualification of the offense in question as posing no great danger to society.

According to Guliev, Aliev's case has no attributes of the second instance, that is, a mitigation of the charge by the party of investigation.
