MCC quashes decision to release Rasul Mirzaev on bail

The Moscow City Court (MCC) has cancelled the decision of the Zamoskvoretskiy Court of Moscow to release Rasul Mirzaev, the world sambo champion, accused of manslaughter of the 19-year-old Ivan Agafonov, on bail of 100,000 roubles.

The "Caucasian Knot" has reported that on February 13, the Judge of the Zamoskvoretskiy Court of Moscow satisfied the motion lodged by Rasul Mirzaev's defence to release the champion from custody under the recognizance not to leave on bail of 100,000 roubles. The Moscow Prosecutor's Office appealed against the decision.

Today, the MCC has upheld the appeal of the Prosecutor's Office, the "Interfax" reports.

Let us remind you that the conflict between Rasul Mirzaev, 25, and the student Ivan Agafonov, 19, happened on August 13, 2011, in central Moscow at the night club "Garage". During a quarrel Mirzaev punched Agafonov, after which the student was taken to hospital where he died on August 18, 2011, without regaining consciousness. On January 12, the prosecution re-qualified Mirzaev's charge from "intentional causing grievous bodily harm entailing victim's death" into "causing death by negligence".

On August 22, 2011, the Zamoskvoretskiy Court of Moscow decided not to arrest Rasul Mirzaev, and released him on bail of five million roubles; however, the prosecution appealed against this decision; and was cancelled.
