Court to consider cassation of the driver who killed Bella Ksalova after New Year

Arsen Abaikhanov, who on July 25 in Karachay-Cherkessia knocked down by his car Bella Ksalova, a "Caucasian Knot" correspondent, who later died, has lodged a cassation complaint to the Supreme Court, claiming that "the verdict was unfair and too severe." As reported by the office of the Prikubanskiy District Court, Abaikhanov's cassation will be considered only after the New Year. So far, he is at large.

"The deadline for accepting cases was December 3, 2010. Since Abaikhanov filed his cassation later, it will be considered in early 2011," a woman-employee of the office explained to the "Caucasian Knot" correspondent. "If the verdict - 3.3 years of imprisonment in a colony-settlement - is upheld, Abaikhanov will go to serve his sentence. If it's cancelled, another trial will be appointed."

Suliyat Nazirovna, mother of the perished girl, believes that "everything is done just to protract time." According to her version, in six months Abaikhanov may be at large.

In response to the cassation complaint of the convict, the judicial collegium for criminal cases of the Supreme Court of Karachay-Cherkessia received an objection from the public prosecutor Arthur Kazanokov, senior assistant of the prosecutor of the Prikubanskiy District. The objection says that Arsen Abaikhanov's complaints about the unfair verdict are unjustified.

Now, Arsen Abaikhanov remains under recognizance not to leave pending a court decision - his freedom restriction measure remains unchanged.
